70 h. Distribution of or sale of prescription drugs. 2. Impaired behavior due to the use of illegal substances or dangerous drugs is prohibited. Impaired behavior is described as behavior exhibited by an individual that requires the attention of a staff member and may be out of the ordinary for that individual, including, but not limited to: slurred speech, inability to walk properly, erratic, belligerent or overly aggressive behavior. Marijuana Policy The College monitors all federal and state regulations, as such, the following policy outlines the prohibition of marijuana use, possession, and distribution, including products that mimic the appearance, small, or packaging of marijuana on college property and during college-sponsored activities. This policy is informed by the following legal frameworks: • Controlled Substances Act (CSA): Under the CSA, marijuana is classified as a Schedule I controlled substance, which makes its possession and use illegal under federal law regardless of state laws. • New York State Marijuana Regulation and Taxation Act (MRTA): While the MRTA permits the regulated use of marijuana for adults 21 and over in New York State, New York colleges and universities are obligated to prohibit marijuana use, possession, and distribution on their premises. • Drug-Free Schools and Communities Act (DFSCA): This federal law requires institutions of higher education to adopt and implement programs to prevent the unlawful possession, use, or distribution of illicit drugs and alcohol by students and employees. Prohibited Conduct In accordance with the above legal requirements, the following activities are prohibited for all students, faculty, staff, and visitors at Wagner College: 1. The use, possession, or distribution of marijuana on college property or during any college-sponsored event or activity, whether on or off campus. 2. The use, possession, or distribution of substances on college property or during any college-sponsored event or activity, that look, smell, or packaged to resemble marijuana, regardless of their actual content. 3. The use, possession, or distribution of paraphernalia associated with marijuana including, but not limited to pipes, bongs, vaporizers, grinders, and rolling papers. 4. Being under the influence of marijuana while on college property or during college-sponsored activities. Medical Marijuana Even though New York State law permits the use of medical marijuana, its use is still prohibited on Wagner College property and at college-sponsored events in compliance with federal law (CSA and DFSCA). Individuals should review their medical needs in concert with the Center for Health & Wellness. Sanctions Violations of this policy by students will result in disciplinary action, which may include but is not limited to: • Students: Warnings, probation, mandatory substance abuse counseling, suspension, or expulsion.
